Manchester City defender Pablo Zabaleta is confident Carlos Tevez will be up for their derby against Manchester United.
Tevez faces court today over driving offences.
Zabaleta said: "He's back to his best form. And we expect that from Carlos because he has worked really well from pre-season. No, it [the court case] doesn't seem to bother him.
"Roberto said the last time (after Tevez was charged and scored a hat-trick v Barnsley) he hopes the police will stop him again because it looks like for him it is a great motivation. It was just a small mistake by Carlos.
"Every time we play against United it is a particularly special game for Carlos. He has always done well against them."
